According to TMZ, she was partying with some friends and the guy, when she realized he was taking photos and video of her. She confronted him, and discovered that he had 50 videos and pictures of her, and was already e-mailing them out to his contacts.
There are two reports of the ensuing confrontation with slightly different details. In Version One, the guy allegedly threw Lindsay on the bed. Lindsay ran out of the room, but returned later, and this time the dude threw her to the ground, got on top of her and started choking her.
A friend was able to pull him off, allowing Lindsay to yank the fire alarm alerting police. The guy -- Christian LaBella -- was arrested on assault and charged with two counts of assault and harassment.
Version Two has Lindsay grabbing LaBella's camera and running from the room, with LaBella in hot pursuit. They allegedly struggled in the hallway, where LaBella choked Lindsay, then someone -- not Lindsay -- pulled the fire alarm, cops came and LaBella was arrested.
CHARGES DROPPED - DUELING HARASSMENT CHARGES: Because there wasn't enough evidence to prove Lindsay's claims, however, the charges against LaBella have been dropped and his arrest voided.
Both have filed harassment charges against each other.
